Divorce Mediation
From 6th April 2011 parties are required to consider with a mediator whether any financial dispute may be capable of being resolved through mediation prior to commencing court proceedings. Family mediation provides an opportunity to address the many issues that may cause concern; including parenting issues and financial matters. The parties will be required to attend a mediation information and assessment meeting and, if dispute is considered suitable for mediation they will both attend further mediation appointments together in the same room or if necessary, separately. Following full and frank financial disclosure the family mediator will assist them to agree upon the division of the matrimonial assets. If this proves successful a Memorandum of Understanding and Open Financial Statement is prepared. The parties are at liberty to consult their legal representatives at anytime whilst they are attending mediation for legal advice. If the financial matters are subsequently agreed the legal representative will draft a consent order which will be filed at court for approval of a District Judge. If approved as drawn the order will be sealed by the court and will become legally binding. |
