Pre-Nuptial Agreements It is a sign of the times that increasing numbers of marriages are ending in divorce. As a result, it is not surprising that many people are trying to plan for this risk by entering into agreements before marriage which seek to protect assets and avoid the cost and stress of future disputes should things go wrong. Whilst these agreements have been around for some time, most judges were, until recently, reluctant to enforce them. The Supreme Court has now made it clear that they can be a reasonable and enforceable method of protecting a spouse's assets provided that certain conditions are met.
